Lease and Usufruct

People always get confused between the concept of lease and usufruct concept as both of them are about enabling someone to get benefit from something that he doesn’t own for a specific period which is specified by the owner and the beneficiary. That’s why Murabahat decided to end this confusion by clarifying the concept of both of them.

  • 1- The Usufruct
    It’s a right that enables someone to get benefit and use a property as he is obliged to safeguard it and return it back to the owner at the end of the specified period. Also, the usufruct expires either by the death of the beneficiary or the end of the specified period. Also, it can’t be inherited. Furthermore, the beneficiary has the right to use the property in any way he sees it is appropriate for him like living in it or renting it without exceeding the period of the usufruct. The beneficiary also can apply modifications to the property with the approval of the owner and ask for it’s cost after the end of the usufruct.
  • 2- The Lease
    It’s a personal right similar to the usufruct in that. It also enables someone to get benefit from a property for a specific period and for a certain cost. Also, the tenant is obliged to safeguard it to return it back to the owner at the end of the rental specified period. It doesn’t expire by the death of the tenant but it can be inherited. Furthermore, the tenant isn’t free to use the property in any other way rather than the agreed one.

Conclusion

From the above, we conclude that there are a lot of similarities between the usufruct and the lease. However, there are many significant differences for each type that made each one of them has its own distinctive qualities and characteristics.
